3 tips for instituting a legal dress code for employees

It is fully legal for an employer to use a dress code. You may want to do this for a variety of reasons. It helps present a uniform front to customers, it promotes professionalism in the workplace and it simply gives your business the branded aesthetic appearance that you want.

However, it is important to ensure that you institute the dress code legally, without violating the rights of any employees. Here are some tips that can help.

1. Don’t target just one gender

One thing to remember is that you should not make a dress code that only applies to a specific gender. For instance, if you say that male employees can continue wearing whatever they would like to work, but that female employees have to wear a specific uniform, you could be accused of gender discrimination.

2. Be wary of religious considerations

You also want to avoid the appearance of religious discrimination, which sometimes happens when employees have certain types of attire that they wear all the time due to their religious affiliation. For instance, say that you have employees who wear a specific type of religious headwear. A dress code that merely prohibits headwear may be seen as discriminatory because it will not affect employees who are outside of this religion.

3. Be sure the rules are evenly applied

Similarly, just consider how the dress code is going to apply to different groups. Ideally, the dress code should affect everyone in the same way, and they should all be given the same sorts of standards and regulations to follow. When the dress code applies evenly and equally to all, then it is legal.
